**Chambers REALTY launch promotion and chance to win a $100,000 cash prize**
**Terms and Conditions**
1. **Eligibility**
i. The promoter is Building In Pty Ltd (ABN 15 141 603 590) trading as Chambers REALTY (Chambers REALTY).
ii. The Chambers REALTY Trade Promotion Lottery (TPL) is open to all Australian residents over the age of 18 years, excluding all employees of Chambers REALTY and their immediate family. An employee’s immediate family is defined to include their spouse and/or their children.
iii. Entrants must be 18 years of age or older at the date of entry in order to be eligible to enter the TPL.
iv. The TPL is limited to 25 entries only.
v. Chambers REALTY reserves the right to request the winner provide proof of identity and proof of residency to claim the prize. In the event the winner cannot provide suitable proof (valid driver’s license with photo, Australian Passport and/or visa), the winner will forfeit the prize in whole and no substitute will be offered.
vi. Chambers REALTY reserves the right to redraw the prize should any winning entrant be found to be in breach of, or otherwise unable to satisfy, these terms and conditions.
2. **TPL Period**
i. Entries in to the TPL will commence from 1 September 2023 and will cease on the earlier of:
a. when 25 entries are confirmed by Chambers REALTY to be received and eligible; and
b. 31 August 2024 .
ii. No late entries will be eligible to enter the TPL.
iii. The TPL period may be altered at any time, without notice.
3. **Eligibility**
i. To be eligible for 1 of the 25 entries into the TPL, entrants must exclusively list their property for sale with Chambers REALTY (based on Chambers REALTY’s standard listing agreement),sell their property, and settle prior to the end of the TPL Period.
ii. If an entrant accepts a conjunctional sale for their property, they are not eligible for entry into the TPL.
iii. A person may be eligible for multiple entries if they list, sell and settle multiple properties in accordance with clause 3.i.
iv. A person may be eligible for an entry into the TPL by referring two separate individuals that exclusively list their property for sale with Chambers REALTY (based on Chambers REALTY’s standard listing agreement), sell their property, and settle prior to the end of the TPL Period (Referral Entry).
v. An individual is referred for the purposes of clause 3.iv if that person is a new contact whose details are provided in writing to Chambers REALTY by the referring party. For the avoidance of doubt, if the person is already in the Chambers REALTY database, that person will not be considered a new contact.
vi. A Referral Entry is only given to the referring party after both of the two new contacts exclusively list their property for sale with Chambers REALTY (based on Chambers REALTY’s standard listing agreement), sell their property and settle, providing that this occurs prior to the end of the TPL Period.
4. **Cash Prize**
i. The prize for the TPL is one (1) cash payment of one hundred thousand Australian dollars ($100,000) to one winner.
ii. Chambers REALTY recommends that independent financial advice should be sought as to the implications (including without limitation, tax) that may arise as a result of accepting the prize.
iii. The prize cannot be transferred or exchanged.
5. **Notification**
i. Each entrant will be notified of their entry into the TPL by Chambers REALTY within 7 days of becoming an eligible entrant.
ii. Chambers REALTY will notify entrants of the date and location of the prize draw,, within 14 days of closing of entries into the TPL.
iii. The draw date will be within 1 calendar month of the closing of entries into the TPL.
6. **Prize Draw and Attendance Requirement**
i. Entrants, or their nominated representative, must be physically present at the prize draw to be eligible to win. If an entrant is not physically present (or does not have a nominated representative physically present) at the prize draw, their entry (or entries) will be removed prior to the prize draw.
7. **Selection of Prize Winner and Payment**
i. The prize winner will be selected using random number generator software or similar.
ii. The process will be supervised by an independent accountant to ensure fairness and impartiality.
iii. The independent accountant’s determination as to the winner is final and cannot be contested. No correspondence will be entered into.
iv. The prize will be paid to the winner within 14 days of the prize draw by electronic funds transfer to the winner’s nominated Australian bank account. All costs and expenses associated with the prize will be the responsibility of the winner.
8. **Publicity**
i. The winner consents to and agrees that Chambers REALTY may use their first name, image or likeness, and property suburb information for marketing purposes without further compensation. Any personal information (relating to the winner or any entrant) will be used in accordance with the Privacy Act 1988.
9. **Disqualification**
i. Chambers REALTY reserves the right to disqualify any entrant found to be tampering (or attempting to tamper) with the entry process or the prize draw or who has otherwise breached these terms and conditions.
10. **Limitation of Liability**
i. Chambers REALTY is not liable for late, misdirected, incomplete, or incorrect entries, or for any computer-related, online communication, or technical malfunctions.
ii. Chambers REALTY is not liable for the loss of prize due to incorrect or imprecise bank account details provided by the winner.
iii. Chambers REALTY is otherwise not liable for any loss, damage, cost or expense if for any reason beyond its reasonable control any element of any prize is not provided or the TPL is suspended, varied or terminated at any time, with or without prior warning or publicity.
11. **Minimum Valid Entries**
i. Without limiting clause 1.iv, the TPL has a minimum requirement of 25 eligible entries for the prize draw to take place. If 25 eligible entries are not received by 31 August 2024 , all eligible entries received at that date will each receive a one-off payment of two thousand Australia dollars ($2,000) as a consolation prize. This consolation prize will be paid to each entrant within 14 days of that date, by electronic funds transfer into the entrant’s nominated Australian bank account.
12. **Modification and Termination**
i. Chambers REALTY reserves the right to modify, suspend, or terminate the TPL in the event of any circumstances that are outside of its control.
By participating in the TPL, entrants agree to accept and be bound by these terms and conditions. The TPL and these terms and conditions are governed by the laws of Western Australia and subject to the exclusive jurisdiction of the Courts of Western Australia.
